The infamous blacklist
There are a lot of lists most of us dreamt to be on (fortune list, most influent people, most eligible bachelor and so on….) but there is one you definitively don’t want to be on, Thailand immigration blacklist.
Note: I would be unfair to Thailand if I did not state that Thailand is not the only country with an immigration blacklist. All countries have one.
Another big problem in Thailand for the professional who like us provide visa services is that foreign visas applicants are often confusing the names of the visas they are having and the benefits attached to say visas. This is why we will dedicate this post and the next post to give definitions of visas terms.
This post is a continuation of our series Thailand Visas: Setting the Record Straight. I wrote this series with a “back-to-basics” kind of approach because I don’t believe that it is possible to understand Thai immigration regulations without having first an understanding of basic terms such as visa, visa class, visa exemption, passport stamp, entry visa, departure visa, multi or single entry and so on…
What is the Visa Exemption?
Pursuant to Thai Immigration Law; any foreign citizen who wishes to enter the Kingdom of Thailand is in principle required to obtain a Visa from a Royal Thai Embassy or a Royal Thai Consulate-General prior to entering Thailand.
Is it difficult to enter and stay in Thailand?
How many times did I hear foreign clients complaining about Thai Immigration policies and how difficult it is to live or stay in Thailand? Believe me we are the lucky one because Thailand gives us VIP treatment in comparison to what Thai citizens have to go through to visit our countries.

Should you purchase off plan?
From experience, we know that most problems occur when buyers purchase property “off plan”. Whether or not the transaction has a favorable outcome will depend solely upon one single factor: Did the buyer purchase from a reliable developer or not? Truth be told, purchasing off plan is no more dangerous when purchasing offshore than in your home country, as long as you are purchasing from a reliable developer who operates in the country where you are purchasing.

What is the disclosure requirement?
The disclosure requirement was one of the measures taken by the Thai Government to avoid the use of Thai nominees by foreign investors. Since August 14th 2006, the Department of Business Development is compelled to require at time of incorporation of a company that the company Thai shareholders justify the source of their investment if certain circumstances are met.

In a previous post I already mentioned the 3G licensing drama but only touched the surface of the matter. In this post I decided to discuss this issue more in depth. According to Wikepedia encyclopedia: “As of August 28, 2009, 250 3G/HSPDA networks have commercially launched mobile broadband services in 109 countries; and out of the 250 networks already operational 169 3g/HSPDA networks support 3.6 Mbit/s peak downlink data throughput. A growing number are delivering 21 Mbit/s peak data downlink and one network has been upgraded to 28Mbit/s. Several others will have this capability by end 2009 and the first network supporting 42Mbit/s network is set to come online in late 2009.” In this context it is a scandal that Thailand still does not have 3G capability.

Many employers in Thailand have found themself condamned for unfair dismissal as a result of court proceedings filed by employees that were terminated following a disciplinary action for violation of the company working rules. The reason for this is that Thai laws are very formal and that the disciplinary procedure must be in conpliance with the law or the working regulation of the company in order to be valid and opposable to the employee.

You cannot read Thai news and not know about the issue of the two brokers that have been recently arrested for spreading rumors about His Majesty the King health that affected the Stock Exchange of Thailand (SET). The Authorities are visibly at a loss on what to do. They seem to believe that they have to do something about it but limit for the time being their answer to punishing the allegedly guilty parties involved and if possible to prevent such a thing of ever happening again.

The Foreign Business Act B.E. 2542 (A.D.1999) (“FBA”) was enacted on March 4, 2000 to replace the Alien Business Act of 1971. The FBA does not regulate the entire matter of foreign investment in Thailand. The FBA purposes are:
